Recently, SCV Sheriff’s Station deputies arrested a suspect on suspicion of assault with a deadly weapon after he allegedly returned to the scene of the crime.
According to reports, the original incident happened on October 15. Deputies responded to what they originally thought was a shooting near Langside Ave. and Soledad Canyon Rd. When deputies arrived they discovered that the shooting was actually a stabbing and that the suspect was nowhere to be found. The victim was taken to an area hospital for medical evaluation.
On Wednesday the 19th, deputies came across the suspect near the same area where the stabbing occurred and arrested him on suspicion of assault with a deadly weapon.
What Is Assault with a Deadly Weapon?
Assault with a deadly weapon (sometimes referred to as aggravated assault) is covered under California Penal Code 245(a)(1) PC and is described as attacking or attempting to attack someone while using a deadly weapon.
A deadly weapon can be anything that’s used as a weapon and capable of inflicting great bodily harm or death. For example, a gun, knife, or dinner plate could be considered a deadly weapon. A straw, thimble, or computer mouse may not.
What Are the Penalties?
Assault with a deadly weapon is a “wobbler” that can be charged as either a misdemeanor or a felony depending on the circumstances of the case and the defendant’s prior criminal history.
When charged as a misdemeanor, the penalties include summary probation, up to 1 year in county jail, and/or a fine of up to $1,000.
Felony charges carry the potential sentences of felony probation, up to 4 years in state prison, and/or a maximum fine of $10,000.
